This Service is offered by BioPure Labs (“BioPure”, “we”, “us”, or “our”). By accessing or using the Service, or by purchasing a product, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

Depending on how you interact with the Service, additional terms may apply (for example, a wholesale inquiry). Where additional terms conflict with these Terms, the additional terms control for that specific interaction unless stated otherwise.

We may modify these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms, so please review this page periodically. We may also modify, suspend, or discontinue the Service, or any part of it, at any time.

The Service is intended for individuals of legal age in their jurisdiction. You represent and warrant that you are of legal age to use the Service and to purchase our products. Certain regulated products may require age verification before purchase.

• All purchases are made pursuant to a shipment contract. Risk of loss and title pass to you upon our delivery of the items to the carrier.
• An order number or confirmation email does not constitute acceptance of your order. We may limit order quantities, refuse or cancel any order, and correct errors, inaccuracies, or omissions (including after an order is submitted).
• Prices and availability are subject to change without notice.
• If a product is received damaged, or if there is a discrepancy between what was ordered and received, please contact us promptly so we can help make it right. Certain items may be final sale and are clearly marked before purchase.
• Payments are processed by a third-party payment processor. Payment information you enter is sent to that processor, not to us, and may be subject to the processor’s terms. You represent that you have the legal right to use any payment method you provide.

Some parts of the Service require an account. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us promptly if you believe your account has been accessed without authorization. You agree to provide accurate, current information and to keep it up to date.

Except where otherwise indicated, all content and materials on the Service — including text, designs, images, graphics, and logos (“Materials”) — are owned by BioPure or its licensors. We grant you a personal, non-transferable, revocable right to access and use the Service for your own lawful, non-commercial use in accordance with these Terms.

You may not copy, reproduce, republish, modify, create derivative works from, distribute, frame, scrape, reverse-engineer, or otherwise exploit the Service or its Materials without our prior written permission. All rights not expressly granted are reserved.

When using the Service, you agree, without limitation:

• to use the Service in compliance with all applicable laws and these Terms;
• not to use the Service for commercial purposes except as we expressly permit in writing;
• not to “spam”, “phish”, or collect or store personal information about others;
• not to disrupt or interfere with the security or proper working of the Service, or upload malware or other harmful files;
• not to attempt to gain unauthorized access to any part of the Service, or use another person’s credentials;
• not to create a false identity, or transmit content that is false, defamatory, abusive, obscene, harassing, or that infringes any third party’s rights; and
• not to post material you do not have the rights to post.

Please notify us promptly if you suspect fraudulent, abusive, or unlawful activity, or any violation of these Terms.

The Service may contain links to websites we do not control. We are not responsible for the content, security, or practices of those sites, and links do not imply our endorsement. We recommend you review the terms and privacy policies of any third-party website you visit.

Our Privacy Policy describes how we collect, use, and disclose personal information provided or collected through the Service. Please review it.

You agree to indemnify and hold BioPure and its affiliates harmless from any claim or demand — including reasonable legal fees — arising out of your use of the Service, your breach of these Terms, or your violation of any law or the rights of a third party.

The Service and its Materials are provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law — including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that results obtained from it will be accurate or reliable.

To the fullest extent permitted by law, BioPure and its affiliates will not be liable for any indirect, special, incidental, consequential, or punitive damages arising out of or relating to your use of, or inability to use, the Service or its Materials. Where liability cannot be excluded, our total liability will not exceed the greater of the amount you paid (if any) in the twelve months preceding the claim, or one hundred dollars ($100).

These Terms, and any dispute arising under or relating to them or your use of the Service, are governed by the laws of the jurisdiction specified by BioPure [governing jurisdiction to be confirmed], without regard to conflict-of-law principles.

The parties will first attempt to resolve any dispute informally. The dispute-resolution mechanism (including whether disputes are resolved by the courts of a specified venue or by arbitration) will be set by BioPure with its legal counsel and reflected here before launch.

Our failure to enforce any provision is not a waiver of it. If any provision is found invalid or unenforceable, it will be severed and the remaining provisions will remain in effect. Section headings are for convenience only and have no legal effect.
